Summary Offense Charges


Summary offenses are just a serious as misdemeanors. Contempt of court — such as a disrespectful act toward a judge or other act capable of disrupting the court — typically is a summary offense. Other types of summary offenses and traffic offenses include crimes such as harassment, minor disorderly conduct, some retail thefts, underage drinking, illegal dumping, and numerous other small offenses. Summary offenses create a criminal record, and need to be taken seriously.

Another difference between summary offenses and misdemeanors is the degree of punishment. Different states have different categories or classes of summary offenses. Pennsylvania’s categories range from a summary offense in the first through the eighth degree. In Pennsylvania, most summary offenses carry a maximum fine of $300 and up to 90 days in jail, however, some carry higher fines.

Protection from Abuse Order(PFA):


PFA stands for a Protection From Abuse order. While it is not classified as a misdemeanor or felony, a PFA is still very serious. Typically when a spouse or loved one feels threatened or abused by another person they may seek the assistance of the courts by asking for a PFA, which is a restraining order preventing a person from having any contact whatsoever with the “abused individual.” Most times people seek PFA’s for legitimate reasons. However, there are times when a PFA is sought as a means to directly cause harm to the other person. Once a PFA is entered against you, you will not be able to talk to, go to, see, be with, call, text, email, or have any contact with that person for three years. If you do, you will be in violation of the PFA and will face up to 6 months in jail for each violation. If you are located throughout the state of Pennsylvania, Attorney Hopkins can help.

Indirect Criminal Contempt(ICC):


ICC stands for Indirect Criminal Contempt. If you have a PFA against you and have been accused of violating it, the police will charge you with an ICC. For each ICC charge brought against you, you face up to 6 months in jail. ICC’s are not a typical type of case, and you need experienced legal counsel. The Erie County Court’s are very harsh with individuals who are found guilty of violating PFA’s. Typically a first offense may be able to get six months probation, but a second or subsequent violation usually means significant jail time.
